The owners have addressed several of the violations cited by the Department of Environmental Management (DEM), including obtaining a trained Class AB Petroleum Operator certification. Efforts to resolve the remaining violations, total 14, are ongoing. One outstanding matter is pending the results of groundwater and vapor point sampling being conducted by an environmental consultant, with testing scheduled on or about June 8, 2026. At the conclusion of this hearing, the Board voted to keep the establishment closed pending further communication regarding the resolution of the remaining Department of Environmental Management (DEM) violations. The Board determined that the unresolved violations may pose a threat to public health, safety, and welfare. Representing Counsel stated that if this were the case, DEM would have taken action as far as operations are concerned. Petition in support of continued fueling operations and convenience store accepted into the record as well as an email from the Environmental Engineer (DEM) of the corrected AB Trained Operator violation marking it as resolved and the groundwater/vapor point sampling date for a compliance check by an environmental consultant.
