is a special meeting of the Providence City Plan Commission. Today is Thursday, 05/07/2026. It is 05:31PM. We will call this meeting to order. Let's do a roll call.
Wednesday, Rachel Dotson.
Noel Sanchez. Shire our manager, VP Sam.
My name is Santa, legal counsel.
Bob Bezar, DPD staff. And I'm Michael Gastako, the chair. Do we have a director's report this meeting?
Okay. Then we will go right into the first agenda item, which is a minor land development project, a request for extension. It's case number 25Dash019MIL, 1107 Westminster Street. Yeah. Yeah.
Which is fake. It's Oh, the mic's probably turned off.
Thank you, I'm from. I need to hear. 1107 West and. We're here with a first of two possible buys that we're here at Xtampion. So the testing period of preliminary plan approval is provided for by state's action.
Draft and also advised it running for 3988. Reason for the delay, there is an ongoing construction project, not housing the property directly next door to this development at 312 Main Street. Excuse me. 3.1 Main Street, which just created the possibility to see both projects at the same time. There are lots of some of them, but my my project, I'll just how long will it it's the project that's building.
Do we know how long it's gonna take?
have any insight as to the the construction period
for the swap open? I'm not sure. I could certainly follow-up with my clients and an idea from the others. This
I don't think it'll allowed in
a year. I don't either. I thought I thought that was probably a twenty four month project.
Yeah. It's a pretty large. And this about starting well, just about out.
So what does that mean? Just come back and see if you need another extension. It may be. I I also don't know if we could perhaps ask the other project, so it might, you know, have an opportunity for staging with both depending on the layout. I'm not sure of that, but
I do suppose we could. Yeah.
I mean, the the expiration reads. Looking at the, at the regulations.
They have the authority to grant for more
Where where's the good, but it doesn't doesn't actually say a year. Right?
It's requested in writing.
Okay. Show me the show me the what's the citation?
452339. I'm in the statute.
Okay. So they could fill a longer. Yeah.
It may be extended for a longer that's gonna be extended for
a longer period than one year for good caution, get requested in writing by the applicant by the. So
you could go for you could go for two years if you want to.
be the request that I submitted to the city planner for the first of two by one year extensions. After those two, thereafter, further extensions.
one year, then then that's what he's asking for.
Do we open this one up to? I didn't think so. So I guess we could entertain a motion to approve the extension. I'll make the motion to approve the extension. Okay.
Alright. All in favor, say aye.
Any opposed? Any abstentions? There's a lot. Motion passes.
Thanks very much. Thank you.
Next up, city council referral. Referral number 3614, regulations for entertainment. This is why we're here tonight for this special meeting.
Yes. Okay. I'll do a brief introduction of this one. So just an overview of how we regulate entertainment in the zoning ordinance. We essentially have a couple of different levels, And what's important to understand is that zoning sets the the the rules to allow for particular uses.
But when it comes to entertainment, there there are also rules around licenses. We have a board of license licenses that that issues things like liquor licenses, and they also issue entertainment licenses under, there are state statutes that that relate to, how licenses are issued, what licenses are required, and so forth. So we have a couple of different categories of entertainment in the zoning ordinance. Excuse me. We have a couple of different categories.
And starting with sort of the least intensive, we have what's called incidental entertainment. And the reason this is in the ordinance is because we wanna be able to have something, that's allowed that doesn't necessarily require a license through the board of licenses. So we define incidental inner entertainment as background music provided in a bar or restaurant. It it can be live music, but not more than not more than three acoustic instruments unamplified prerecorded music, just sort of background music played over a pre pre existing a permanently installed sound system. And you can't have a cover charge.
There's no dancing. There's no flashing laser flashing lights, lasers, strobe lights. Basically, you're not there for the show. You're there for eating and drinking, and the entertainment is just something that's purely in the background. And that's specifically defined in the zoning.
